Rogan describes the USPS sponsorship fraud lawsuit against Lance Armstrong as already having resulted in a $100 million win. At the time of this December 2015 taping, the federal False Claims Act suit (United States ex rel. Landis v. Tailwind Sports Corp., et al.) had not gone to trial or been resolved; it remained in litigation for more than two more years. When the case did resolve, in April 2018, Armstrong agreed to pay $5 million to the government to settle the claims (plus $1.65 million to whistleblower Floyd Landis for legal costs), a small fraction of the up-to-$100 million in treble damages the government could have sought under the False Claims Act. No $100 million judgment or settlement was ever entered against Armstrong in this case. The claim as stated -- that the plaintiffs "won $100 million" -- is false; the actual resolved amount was $5 million.
